Dear Panelist,

Further to our last update on the execution of the exit policy. we wish to inform our SpeakAsia community that we have finished analysing the results of the first test batch of payouts that were sent.  

We have identified certain roadblocks such as multiple claimants to the same panelist id or bank details not matching with the ones submitted at the time of applying for the exit policy, because of which not everyone got the remittance in their accounts.

We are at this moment addressing those issues and hope to have a resolution to them by the end of this month. Once we have the resolutions in place we will then send out a second batch of test payouts. On successful completion of this second batch we will commence the payout as per the exit policy. 

We understand that there are delays in the process. One of the main contributor to this delay is the fact that we have had to do all the transactions and checking manually as our old automated systems are still under the custody of EOW Mumbai Police. We appeal to all the SpeakAsians to remain patient and bear with us as we work feverishly towards attaining our goals.

Dear SpeakAsians,

 A few pages such as speakasia online support are fraudulently claiming to be the official company pages in the social networking sites such as Facebook. We would like to state that the company has only one official medium of communication that is Speakasiaonlinemarketing.blogspot.com. Anybody else claiming to represent the company is doing so falsely and the company is initiating strict legal action against such websites & social networking sites. 
On the payout front, the company had sent out the first set of test remittances to the bank accounts of some of the panelists. The company at the moment is collating the data as to who all have received it and for those who didn't get it, the company is identifying the cause and finding remedial solutions for it. Once this exercise is complete the company will then start the payout process in full swing.

Processing of the Exit Option

Dear SpeakAsians,

As per the recent Order passed by the Hon’ble Supreme Court, the mediation proceedings have come to an end. However, SpeakAsia continues to stand by its commitment for releasing the payment to its panelists. It is therefore putting in motion the execution of its exit policy and as an initial step, SpeakAsia will be executing the payouts for a test batch of panelists.

This exercise should take a couple of weeks as confirmation e-mails would be sent first to those panelists and then the amounts would be transferred upon receipt of confirmation. After successful execution of the test batch, we will initiate the rest of the payout based on the data available with us as per the exit option. Should we face any difficulties in executing the payouts, we will then approach the concerned authorities to seek remedial solutions. We will also keep all of you posted on the developments as it happens.

Dear SpeakAsians,

 
In furtherance to our earlier communication and also to bring more clarity to the subject please find below the course of action as being decided by the company:-

1) Whilst waiting for the Order passed by the Hon’ble Supreme Court to be made available to us, we would like to repeat and reiterate that payments to panelists opting out under the EXIT option remain the utmost priority for the Company.
 
2) At this stage, particularly since mediation process could not be completed, the Company would now take necessary legal steps to remit the payments to the panelists directly.
 

3) The Company is also in the process of approaching concerned Government authorities for seeking possession of the Panelist database in order to authenticate the information.

4) The Company would also approach the banks and RBI for the purpose of remittance of payments. An ascertainment date about disbursement will be provided once above formalities are done with.

5) In the meantime, the Company would also await Speaking Order from RBI which has to be passed by RBI by September 27, 2012 as per the Order of Bombay High Court and take appropriate steps as per the same.

The company has been fighting its battle for survival for more than a year’s period and at this stage, your cooperation and patience     in this battle is highly appreciated. We would urge the same deliberation from all of you for times to come.

 With all the efforts in line we are bound to overcome the difficult times.

This is further to our last update regarding a company namely Reliance E-Biz Ltd and its website ehaatbazaar.com.

We have repeatedly appealed to this company and to its website not to commit fraud or mislead & misguide the SpeakAsia family members in Bangladesh by claiming that they are the new entity of SAOL in Bangladesh.  As Reliance E-Biz Ltd and ehaatbazaar.com.  Continues to carry on with its fraudulent ways, SAOL has decided to initiate legal proceedings against them. Please find attached a copy of the lawyers notice sent to them by our corporate legal counsels.

We also take this opportunity to assure all the members of the Speakasia Family in Bangladesh that the company will formally and officially launch its operations in the country once it has received all its clearances to do business in the country.

It has been reported in a couple of blog sites that two companies namely Reliance E-Biz Ltd and E-Haatbazaar (website www.e-haatbazaar.com ) are claiming to be associated with SpeakAsia Online Pte Ltd. And that the existing RP of the members will adjusted by these two new companies.

We wish to categorically state that SpeakAsia Online Pte Ltd. has no connection with the above mentioned entities in any manner whatsoever. Furthermore the company has not authorized any of the above mentioned organization to redeem or consume the RP earned by the members in SAOL.

We would like to state that the website access passwords and database access was taken over by the Economic offences Wing of the Mumbai Police and has not yet been restored to us.

Dear Speakasians,

Yesterday was a very important day for us as our matter was heard by Hon'ble Supreme Court and we got a favourable response in the interest of all our panelists. We are happy to share that Honourable Court gave a patient hearing to our learned counsels and the other parties. The Hon'ble Court heard our plea that EOW is making baseless objections in sharing our data and we are not getting any cooperation from EOW in resolving the matter and disbursement of money which is already lying with the Registrar of Hon¹ble Supreme Court.  Based on our pleas, the Hon¹ble Court directed EOW to hand over the data to the Hon'ble Court on the next date fixed as 8th August for final disposal.

This indeed is a great achievement as we are inching close to our victory. What normally takes years to achieve, we have been able to get in just 3-4 months. We will use this interim period to consolidate our position which should help in early resolution of our problems.

We would also like to point out that Mr. Navnit Khosla has been consistently pursuing the matter in one form or the other and in different forums despite AISPA members handling his claims and his affidavit in that regard before Hon¹ble Mumbai High Court.  We fail to see his ulterior motive to derail the process of disbursement of money to panelists who have chosen to exercise the company’s exit option.

We would also like to share with you that we are taking legal opinion regarding early resumption of our business in India. We understand that some misguided people will try to spread panic and create doubts in the minds of our people. Also, do not give any of your personal details to any unauthorised person or on website which claims to be collecting data on behalf of the company.

We once again urge all our Speakasian family members to remain calm and patient as the resolution to our problems are well within our sights.

Dear SpeakAsians

Since the last update, there are several issues we would like to address and clarify with our valued panelists. It is important that you understand our position and the actions we are taking.

1. Media Reports

The Times of India reported recently that we have sister companies that have been investigated for fraud.  There is no truth in this and we categorically deny that SpeakAsia has anything to do with either of these companies.  The companies mentioned are Red Carpet and Index AdMatrix. As for Seven Rings International, they were the publisher of the E-Zine magazine which was distributed by HVP.  SpeakAsia has no interest, commercial or otherwise, in any of their operations.  The reports in the Times of India are false and seem to be motivated by certain vested interests.  We have, on more than one occasion, offered to clarify our positions regarding the various issues with the Times of India, but unfortunately, our offer was not accepted.

2. Exit Policy

As you are aware, we have submitted a list of all those members who have opted to exit to the learned mediator.  The Mediator, accordingly had instructed the EOW and Mumbai Police (which still had in possession our company’s data and server) to return the database of our members to the Mediator for the disbursement process to commence.  However, the EOW and Mumbai Police have filed an affidavit in the Supreme Court refusing to submit the data to the Mediator.  We have also filed an appeal against this action.  Once this issue is resolved, we will resume the process of implementing the exit policy

3. Resumption of Business

The company has also initiated various steps for the resumption of our business.  Dialogue with various departments and authorities is underway with regard to PE formation, statutory clearances etc.  We would like to assure all our SpeakAsian Family members that we wish to quickly resume business once all the legal requirements are fulfilled.

4. Contact with the company and officials

As you know, we welcome your feedback.  Because of the overwhelming amount of emails we received on our present email address, our responses to you have been far from ideal.  To remedy the situation, we have created exclusively for India more email addresses according to the regions.  They are:-

SpeakAsia is pleased to note that the complainant, Navnit Tarachand Khosla, had withdrawn his complaint against SpeakAsia in a filed affidavit on 21 March 2012, as he had his subscription amount returned to him.

With this development, SpeakAsia hopes it can start on the road to resume its operations soon.

Dear SpeakAsian’s,

Our Family of Speakasians stood rock steady by us through one of the most troubled time in the corporate history of any company. We were attacked maliciously by certain sections of the media, hounded by the authorities, and attempts were made to crush our total entity. However we continuously maintained our commitment to our cause and the protection of the interest of our family.

In these troubled times we gave an ‘Exit Option’ to all those who wanted to leave our fold. A total of 94,334 panelists decided to exercise this option (this is less than 7% of our entire universe of Speak Asians.)  We respect their wishes and would gladly welcome them back with open arms whenever they decide to re-join our family. Any other members of the Speak Asians family who still want to exercise the exit option can do so till 31^st March 2012.

On the orders of the Honorable Supreme Court of India a mediator was appointed to ascertain the dues of all those who wanted to exit the company, and the process to settle the their legitimate dues is well underway. As a manifest of our intent and to demonstrate our never ending commitment to our family of Speakasian’s we have voluntarily deposited a sum of US $ 10 Million, with the Registrar General – Supreme Court. We have further committed to deposit any more amounts due, post the ascertainment of the honorable mediator and proactively facilitate the disbursement process.

We stand committed to all our panellists, our employees, trade partners, and the nation at large. Our endeavor to create a whole new marketplace through our patented ‘Precision Marketing Tool’ stands. We cannot thank you enough for all your support. The end of our woes is near, and soon the new sun heralding brightness of our future will dawn.
